Data protection

The protection of your personal data is of particular concern to us. We therefore process your data exclusively on the basis of the legal regulations (GDPR, DSG 2018, TKG 2003). In this data protection information, we inform you about the most important aspects of data processing on our website.

You can visit our site without providing any personal information. We only store access data without personal reference, such as the name of your internet service provider, the page from which you are visiting us or the name of the requested file. These data are evaluated exclusively for the improvement of our offer and do not allow any conclusions to be drawn about your person. Personal data are collected only if you voluntarily provide them to us when ordering goods or when opening a customer account or registering for our newsletter.

If you contact us by form on the website or by email, the data you provide will be stored for the purpose of processing your inquiry and in the event of follow-up questions. We will not pass on these data without your consent.

2.1    We need the collected personal data for contract fulfilment and customer service. The data are collected, stored, processed and used for this purpose.

2.2   Without these data we cannot conclude the contract with you. Data will not be transmitted to third parties, with the exception of the transmission of the necessary data to:

  • · the processing banks / payment service providers for the purpose of debiting the purchase price
  • ·to the transport company commissioned by us to deliver the goods
  • · as well as to our tax consultant for the fulfilment of our tax obligations.

2.3   The legal basis for the processing of your personal data is, on the one hand, contract fulfilment (e.g. online purchasing), legitimate interests, the fulfilment of our legal or contractual obligations as well as your consent (e.g. contact form, newsletter, cookies). Failure to provide the data can have various consequences.

2.4  In addition, we process data that we have legitimately received from therapists or trainers using the Klinghardt method. This is basic personal data such as: your name, as well as your preferred contact information (email address, address, telephone number, etc.).

2.5   We process your personal data (name, addresses, email address, ordered goods, date of purchase), if necessary, for the duration of the entire business relationship (from the initiation and handling up to the termination of a contract) and beyond that in accordance with the legal storage and documentation obligations, which result among other things from the Austrian commercial code (UGB) and the federal tax code (BAO) as well as up to the termination of any legal dispute or continuous warranty and guarantee periods etc.

2.6   As part of the operation of our websites, we commission banks, PayPal, EDP service providers and hosting companies, which may gain access to your personal data in the course of their activities, provided that they require the data to fulfil their respective services. These contractors have undertaken to comply with the applicable data protection regulations.

3.1    Your details, including personal data from our contact form, will be transmitted to us via a mail server, processed and stored by us for processing your request. These data will not be collected or passed on without your consent. Without these data we cannot process your request.

3.2   Data processing is carried out on the basis of the legal provisions of Art. 96 Sec. 3 TKG and Art. 6 Sec. 1 lit a (Consent) GDPR.

  1.  4.     Newsletter

4.1    You can register for our newsletter on the website using the double opt-in procedure. After registering, you will receive an email asking you to confirm your registration. Without disclosing these data, it is not possible for us to send you our newsletter. You can unsubscribe from the newsletter by clicking the unsubscribe link at the end of each newsletter.

4.2  We instruct contractors to send our newsletter. These contractors have undertaken to comply with the applicable data protection regulations.

4.3   Data processing is carried out on the basis of the legal provisions of Art. 96 Sec. 3 TKG and Art. 6 Sec. 1 lit a (Consent) GDPR.

  1. 5.      Online purchases

5.1    We would like to point out that for the purpose of simplifying the purchasing process and for subsequent contract processing the webshop operator stores the IP data of the connection owner within the framework of cookies, as well as the name, address, purchased goods and the date of purchase. In addition, the following data will also be stored by us for the purpose of contract processing: name, addresses, email, phone number, purchases, the complete email traffic. The data provided by you is necessary for the fulfilment of the contract or for the implementation of pre-contractual measures. Without these data we cannot conclude the contract with you.

5.2   Data such as name, email address, bank details, credit card data, PayPal data, etc. are transmitted to

  • the processing banks/payment service providers for the purpose of debiting the purchase price
  • to the transport company/shipping company commissioned by us to deliver the goods
  • · to our tax consultant for the purpose of fulfilling our tax obligations.

These contractors have undertaken to comply with the applicable data protection regulations. An order processing contract was concluded in accordance with Art. 28 GDPR.

5.3   Data processing is carried out on the basis of the legal provisions of Art. 96 Sec. 3 TKG and Art. 6 GDPR (in particular consent and/or necessity of contract fulfilment).

 

  1. 6.      Cookies, other tracking tools as well as web analysis tools

6.1 Cookies, other tracking technologies and functions of the web analysis service Google Analytics can be used on our internet platform in many different ways. Cookies are small pieces of text information that enable the recognition of the user and analysis of your use of our websites. The information generated in this way is transferred to the provider’s server and stored there. They serve to make our website more user-friendly, effective and secure. Cookies are also used to measure the frequency of page views and for general navigation.

6.2 By using our website, you consent to us using cookies. You can refuse the acceptance of cookies in your browser settings. Please refer to the instructions of your browser manufacturer to find out how this works in detail. If you choose not to accept certain technical and/or functional cookies, the functionality of our website may be restricted. Some cookies remain stored on your device until you delete them.

6.3  We have concluded a corresponding contract with the provider for order data processing. These contractors have undertaken to comply with the applicable data protection regulations.

6.4  Your IP address is recorded.

6.5   Data processing is carried out on the basis of the legal provisions of Art. 96 Sec. 3 TKG and Art. 6 GDPR.

  1.  7.      Consent and right of revocation

7.1   If your consent is necessary for the processing of your data, we will process it only after we receive your express consent.

7.2 In principle, we do not process any data of minors and are not authorised to do so. By giving your consent, you confirm that you are 14 years of age or have the consent of your legal representative.

7.3   You may withdraw your consent at any time at the following email address: mail@biopure.eu. In this case, the data previously stored about you will be made anonymous and subsequently used only for statistical purposes without personal reference. Withdrawal of consent does not affect the legality of the processing carried out on the basis of the consent until withdrawal.

8.1 We use technical and organisational security measures to protect the stored personal data against accidental or intentional manipulation, loss or destruction and against access by unauthorised persons. Our security measures are continuously improved in line with technical progress.

 

  1. 9.      Your rights

9.1 You have the right to access your personal data at any time. As far as there is no legal storage obligation, you have the right to the deletion of these data as well as objection against the processing. You also have the right to rectification of your data, restriction of processing, data portability and appeal to the Austrian Data Protection Authority (Wickenburggasse 8-10, 1080 Vienna, email: dsb@dsb.gv.at).
